Should Texter and Textee Face Distracted Driving Charges?

A New Jersey motorcycle accident lawsuit could expand liability in distracted driving cases. In 2009, a pick-up truck crashed into a motorcycle, severely injuring the two riders (both lost part of a leg). The truck driver was replying to a text message, and prosecutors will decide this month whether the woman who sent the text is partially liable for the accident. Driver Kyle Best, 19, was texting back and forth with Shannon Colonna, 19, when his vehicle drifted across the median and crashed into David and Linda Kuthbert’s motorcycle. The Kuthberts initially brought the lawsuit against Best, but they have now expanded it to include Colonna. “They were texting back and forth like a verbal conversation,” said Stephen Weinstein, the Kuthbert’s attorney. “She may not have been physically present, but she was electronically present.” Weinstein claims that Colonna, familiar with Best’s schedule, had to know that Best was driving at…

Can Motorcycles Share Lanes?

We get this question a lot: are two motorcycles allowed to share a lane? Like many motorcycle laws, this one varies by state. In most states, it is legal for two motorcycles to share a lane. Colorado motorcycle laws, along with Wyoming and Nevada motorcycle laws, state that two motorcycles can share a lane, though they may not share a lane with a car or engage in lane splitting – riding in between cars on the lane divider. Lane splitting is common in many Asian and European countries that have a high percentage of motorcycle riders on the road, but most U.S. states outlaw that practice. Police Hope Video of Airborne Motorcyclist Encourages Safe Driving

Motorcycle accidents are some of the more common accidents on the road today, but rarely are they caught on tape. Police video shows Greg Edwards of Aurora flying from his motorcycle after a car ran a red light and broadsided him. Edwards has one piece of advice for motorists: “Try to be more aware of motorcycle riders,” he told the Denver Post. His words are especially pertinent as Motorcycle Safety Awareness Month reaches its halfway point. The main goal of Motorcycle Safety Awareness Month is to reduce motorcycle accidents by increasing awareness of motorcyclists’ presence. If the driver had been more aware of her surroundings, Edwards could have avoided a fractured ankle, fractured femur, chipped teeth and a six stitches in his lip.
